By accessing or using iPixelCafe (the "Site"), you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this Site or make any purchase.

To purchase a pixel on iPixelCafe, you must be of legal age to enter into a binding contract and hold a valid credit card or payment method in your country of residence. By completing a purchase, you represent and warrant that you meet this requirement.

iPixelCafe does not knowingly accept payments from minors. If we discover that a purchase was made by someone not of legal age to do so, we reserve the right to remove the pixel and the purchase will not be refunded.

Each pixel on the iPixelCafe wall represents a unique, permanent digital space. When you purchase a pixel, you are purchasing the right to display a message, name, or time capsule in that pixel space on the iPixelCafe wall, subject to these Terms.

This includes but is not limited to:

• Change of mind or personal circumstances
• Dissatisfaction with the appearance of the pixel on the wall
• Technical issues on the buyer's device or browser
• Failure to use the pixel after purchase
• Pixel removal due to violation of these Terms

If your pixel is removed by iPixelCafe for any violation of these Terms, including content violations, no refund will be issued. By purchasing a pixel, you acknowledge and accept this condition.

The message, name, or content you submit with your pixel must comply with the following rules. iPixelCafe reserves the right to review, edit, or remove any content that violates these terms at any time, without prior notice, and without any obligation to issue a refund.

The following content is strictly prohibited:

• Hate speech or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Threats, harassment, or content intended to intimidate or harm any person or group
• Sexually explicit or pornographic material
• Content that promotes, glorifies, or facilitates illegal activity
• Personal information of others without their explicit consent
• Spam, advertising, or promotional content for third-party products or services
• Impersonation of any person, brand, or organization
• Content designed to deceive, mislead, or defraud other users or visitors
• Any content that violates applicable local, national, or international laws

iPixelCafe reserves the right to determine, at its sole discretion, whether content violates these rules. Our decision is final.

Time Capsule pixels are a special pixel type where the message is hidden until a future unlock date selected at the time of purchase. The following conditions apply:

• Once a Time Capsule unlock date is set, it cannot be changed
• The message will become publicly visible on the wall on the unlock date
• iPixelCafe does not guarantee that the Site will be operational on any specific future date, though we commit to making every effort to preserve the wall and honor all Time Capsules
• Time Capsule content is subject to the same content rules as all other pixels and may be removed without refund if found to violate these Terms

When you purchase a pixel, you are purchasing a limited, non-exclusive, non-transferable right to display approved content in that pixel space on the iPixelCafe wall. You do not own the pixel itself, the underlying technology, or any part of the iPixelCafe platform.

iPixelCafe retains full ownership of the wall, the platform, and all associated intellectual property. Pixels are not transferable and may not be sold, assigned, or sublicensed to any other party.

iPixelCafe is committed to maintaining the wall as a permanent digital monument. However, in the event that the Site is permanently shut down or becomes inoperable:

• iPixelCafe will make reasonable efforts to provide advance notice to pixel owners
• A static archive of the wall will be preserved and made publicly accessible wherever reasonably possible
• No refunds will be issued in the event of a site shutdown

The name and message you submit with your pixel will be publicly visible on the iPixelCafe wall. Do not submit any personal information you do not wish to be publicly displayed.

iPixelCafe collects only the information necessary to process your purchase and display your pixel. We do not sell your personal data to third parties. Payment processing is handled securely by Stripe. iPixelCafe does not store your full credit card details.

By submitting content to iPixelCafe, you grant iPixelCafe a worldwide, royalty-free, non-exclusive license to display, reproduce, and promote your pixel content in connection with the iPixelCafe platform, including in marketing and media materials.

You represent and warrant that you own or have the necessary rights to the content you submit, and that it does not infringe on the intellectual property rights of any third party.

To the maximum extent permitted by applicable law, iPixelCafe and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or your pixel purchase.

iPixelCafe's total liability for any claim arising under these Terms shall not exceed the amount you paid for your pixel.

iPixelCafe reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after any changes constitutes acceptance of the revised Terms.

These Terms of Service shall be governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
